This document establishes the General Conditions of Use and General Conditions of Sale for the website www.fly-baby.net and all subdomains/subwebsites. Browsing the website and/or purchasing any product through it implies acceptance of these General Conditions.

Property

The domain www.fly-baby.net and its subdomains are the property of FlyHome, lda, with NIFC: 515 340 359. The use, reproduction, copying and dissemination by other means of logos, texts, images and videos on this website is subject to prior written authorization.

Changes
FlyBaby reserves the right to modify the general conditions of use and other regulations published on the website www.fly-baby.net and its online store without prior notice, so use of the website presupposes acceptance, without reservation, of the version most recent of these general conditions of use.

The website www.fly-baby.net and its online store may have "links" to other websites, which are not covered by these general conditions of use, and their contents are the exclusive responsibility of their respective owners.

 

1. PRODUCTS AND PRICES

1.1. Products
Information about the products presented: images, descriptions, prices, promotions, commercial conditions and others, may be changed without any prior notice. The images shown may not strictly correspond to the settings described. The color reproduction of the products is the closest to reality, and may vary depending on the type of device on which they are viewed. If the information presented does not correspond to the characteristics of the product, the customer will be informed when confirming their order.

1.2. Pricing
Prices are shown in euros and include VAT at the legal rate. The prices of products, promotions and commercial conditions at www.fly-baby.net are exclusive to the online store and may be different from those charged in the physical store. In the event of a computer, manual, technical error or any other error that causes an unforeseen substantial change in the retail price, such that it becomes exorbitant or derisory, the order for that product will be considered invalid and canceled. . The customer will be informed of this situation when confirming the order.

The prices of ordered products are always checked upon receipt of the order. If there is any anomaly, error or price difference, the customer will be informed in the order confirmation email and can confirm or cancel their order.

1.3. Product Availability
Once your purchase is successful, you will receive an email with information about product availability and delivery times. If you have already made the payment and the product is out of stock or has a very long delivery time and you do not want to wait for it to arrive, the amount paid will be refunded to you.

2.3. Virus
FlyBaby (FlyHome, lda), does not guarantee the absence of viruses or similar elements in electronic documents and files stored in its computer system and on its website, and is not responsible for any damage caused and derived from the possible presence of viruses and other elements analogues.

FlyBaby ( FlyHome, lda ). reserves the right, without prior notice, to change and update security procedures and/or the privacy and data protection policy.

 

3. HOW TO BUY

To make purchases at the FlyBaby online store, you just have to follow the following steps:

1 - Select the desired area and product category.

2 - Click on the item you prefer and a page will appear with all the details about that product: price, reference, available colors and sizes and technical information.

3 - To purchase the product, simply "Add to Cart". In the upper right part you will see how many products are in your cart and when you move the cursor over them you will be able to see which products have been added, individual value, shipping costs and total value.

4 - To complete your purchase, you will have to log in (if you already have an account created) or you will have to register (if you have not yet created an account). You will then receive an email confirming your registration.

5 - Select whether you want to collect the product at the FlyBaby store in Rio Tinto or send it to your address and you will be informed of the shipping cost.

6 - Choose the payment method: Bank Transfer or Credit/Debit Card Payment (Stripe)

7 - Confirm the purchase. Once this is done successfully, you will receive an email with information about product availability and delivery times. Payment should only be made after receiving this confirmation email. If you have already made the payment and the product is out of stock or has a very long delivery time and you do not want to wait for it to arrive, the amount paid will be refunded to you. If a product is not available and has a longer delivery time than the other products in your order, you can choose between partial receipt of the order (of available products) and subsequent receipt of the remaining products or wait for the availability of all products and receive the order complete.

 

4. PAYMENT METHODS

Along with the order confirmation email, the final amount you must pay will be sent.

This amount can be paid as follows:

4.1. BANK TRANSFER

If you wish to proceed with the Bank Transfer, the amount of the order must be transferred to the FlyHome, lda account with IBAN - PT50 0035 0329 00010168 930 42 and BIC SWIFT – CGDIPTPL (CAIXA GENERAL DE DEPÓSITOS). During the process, you must indicate the order number to which the transfer refers (in case of possible communication failure and effective identification of the Customer).

Important Note: Once your purchase is successful, you will receive an email with information about product availability and delivery times. Payment should only be made after receiving this confirmation email. If you have already made the payment and the product is out of stock or has a very long delivery time and you do not want to wait for it to arrive, the amount paid will be refunded to you.

You have 48 hours to make the payment. After this period, the order will be automatically cancelled. You can cancel your order at any time before making payment.

4.2. MBWAY AND MULTIBANCO

4.3 PAYMENTS IN INSTALLMENTS VIA FLOA

Pay in 3 installments, Pay in 4 installments, or in deferred payment free of charge with a debit or credit card with your FLOA partner.

FLOA BANK, a public limited company (société anonyme), with share capital of €72,297,200, registered in the Bordeaux commercial register with number 434 130 423, with registered office at Bâtiment G7 - 71 Rue Lucien Faure in Boreaux (33300), FRANCE. It offers payment solutions reserved for individuals (individuals of legal age) residing in Portugal and holders of a Visa or MasterCard bank card with an expiration date corresponding to the duration of the refund that allows you to pay for your purchases of goods and/or services, through “Deferred Payment”, “Payment in 3X” or “Payment in 4X”, interest free.

After completing your order, you must choose to pay using the desired payment method “Deferred Payment”, “Payment in 3 installments” or “Payment in 4 installments” by Credit Card; You will then be redirected to the FLOA BANK website, where you can make your payment. 5. DELIVERY TIMES

5.1 PRODUCTS IN STOCK:
Dispatched within two working days;

5.2 OUT OF STOCK PRODUCTS: Dispatched within 15 to 30 days (unless the supplier runs out of stock);

5.3 CUSTOMIZED FURNITURE AND ITEMS:
5 to 7 weeks;

In the event of a delay due to force majeure, FlyBaby undertakes to inform the Customer and make its best efforts to resolve the situation as quickly as possible.

6. SHIPPING AND DELIVERY

6.1. ORDER RECEIPT

To receive your order, you can choose between these two solutions:

Shipping to the address defined as the delivery address in your account – the order will be sent by courier to the address you indicate to us during the order completion process. If there is not always someone at home at that address, you can choose to receive your order at the Pickup point closest to you.

Store Delivery – you can collect your order at the FlyBaby store (Avenida da Conduta nº 84 4435-385, Rio Tinto), at the following times:
MON-FRI: 10:00-12:30h and 14:30-18:30h
SATURDAY: 09:30-13:00
SUNDAYS AND HOLIDAYS: closed

All delivery details will be sent to you by email. If delivery is not possible due to an incorrect address or if there is no one at the indicated address, the order will be returned to FlyBaby and reshipment will be paid for by the customer.

6.2. SHIPPING COSTS

Delivery to the store – Free (Mainland)

For deliveries to the address indicated in the order process (mainland), the shipping cost will be calculated automatically when the order is finalized. Shipping to Madeira and Azores archipelagos or foreign countries, the shipping cost will be calculated on a case-by-case basis and will appear in the order confirmation email.

6.3. ORDER STATUS

Your order will only be processed after confirmation of payment. In your private area, which you can access by logging in, you can check the status of your order.

 

7. EXCHANGES AND RETURNS

7.1. CONFERENCE AND VERIFICATION OF ORDER

All products sent via the carrier must be checked by the customer upon receipt. If any damage or defect is detected in the product, the customer must refuse delivery, returning it to the carrier, indicating the reason for refusal on the delivery note. You must also inform FlyBaby via the customer support line.

Proof of delivery without reference to damage is equivalent to a product delivered in perfect condition. 7.2. EXCHANGES, RETURNS AND COMPLAINTS

The customer has 14 days to return or exchange their order. You have two options to do this:
- Deliver to the FlyBaby store, located at Avenida da Conduta nº 84 4435-385 - Rio Tinto, presenting the invoice.
- Contact our Customer Support Line at +351 Tel. +351 223 161 190 [Call to national fixed network]
or email: geral@fly-baby.net , indicating the cause, the invoice number and the reference of the product to be returned or exchanged.

The return/exchange must comply with the following conditions:
1 - Products to be returned or exchanged must be in perfect condition, complete, with all their components, accessories and instruction manual, must be accompanied by the original packaging and all packaging components in perfect condition, with the respective labels intact and without any sign of use. They must be properly protected so as not to be damaged during transport.
2 - Transport and/or return costs are the sole responsibility of the customer.
3 - Exchanges or returns cannot be accepted in the case of goods made or configured according to customer specifications, or clearly personalized, hygiene products or products that, due to their nature, cannot be sent or are likely to deteriorate or perish quickly.

Please be aware that we do not accept returns of items that are batch numbered, such as wallpaper. We do not accept returns of products ordered to order that we do not stock in the physical store.

Returns or exchanges that do not comply with the procedures indicated above will not be accepted. After receiving the products and duly checking them in accordance with the return/exchange conditions, a refund voucher will be issued, valid for 30 days and which you can use on your next purchase.

7.3 WARRANTY

All products are covered by the warranty required by law.

FINAL DISPOSITIONS

These general conditions are governed by Portuguese Law. All disputes arising from the interpretation or execution of this agreement will be settled by the Porto District Court, with the express waiver of any other dispute.
